HailOut Terms of Service

Effective Date: May 18, 2026

By receiving SMS messages from the HailOut Service operated by Avialdo LLC (“we”, “us”) you (“you”, “recipient”) acknowledge these Terms of Service.

Program name and description

Program name: HailOut. Operator: Avialdo LLC. HailOut is a real estate SMS program. We send marketing and customer-care messages to real estate listing agents and property owners who have opted in through our web form, about their listing, and follow up conversationally when the recipient replies. Messages may be drafted and sent by a person, an AI agent, or both; if asked, our AI agent will identify itself as an AI. Message frequency

Message frequency varies based on your listing activity and replies. You will receive an opt-in confirmation immediately after subscribing, followed by messages about your listing.

Message and data rates

Message and data rates may apply depending on your mobile carrier and plan. We do not charge you to send or receive messages from us.

Carriers and providers

We use Twilio, Inc. and Telnyx LLC as our SMS delivery providers. We are not the carrier; carriers are not liable for delayed or undelivered messages.

HELP and STOP instructions

Reply HELP to any message we send to receive support information. Reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message to opt out. Opt-out is permanent and honored within 24 hours of receipt per the Telephone Consumer Protection Act (TCPA). You may also email info@avialdosolutions.com to request removal.

No warranties

The Service is provided on an “as is” and “as available” basis. We make no warranty that messages will be delivered, that any reply will be received in real time, or that any transaction will result from a conversation initiated through the Service.

Limitation of liability

To the maximum extent permitted by law, Avialdo LLC is not liable for any indirect, incidental, consequential, or punitive damages arising from your receipt of or response to messages from the Service. Our total liability to you for any claim related to the Service will not exceed one hundred dollars (USD 100).

Changes to these terms

We may update these Terms from time to time. Continued receipt of messages after the Effective Date constitutes acceptance of the updated Terms; if you do not accept, reply STOP to opt out.

Governing law

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules.
